Terms of Use

Last updated: 27. August 2026

1. Scope and Provider

These Terms of Use govern the use of the SupplyBay web application (hereinafter “SupplyBay” or the “Service”). The provider is:

Moritz Foglia
Leihgesterner Weg 36
35392 Gießen, Germany
Email: kontakt@supplybay.de

By registering a user account, you accept these Terms of Use. Any deviating terms proposed by the user shall not apply unless we expressly agree to their validity in writing.

2. Description of Services

SupplyBay is a tool for monitoring eBay listings. After connecting your own eBay account, SupplyBay retrieves stock, price, and availability information for the monitored items via the eBay Trading API and the eBay Browse API, and, upon request, notifies the user by email of relevant changes (e.g. items selling out or running low on stock).

SupplyBay is an offering independent of eBay and has no connection to eBay Inc. or eBay International AG. The Service is neither operated, authorized, sponsored, nor endorsed by eBay. “eBay” is a registered trademark of eBay Inc.

As SupplyBay relies on data and interfaces provided by eBay and other third-party providers, we make no guarantee regarding the continuous availability, accuracy, completeness, or timeliness of the data obtained via the eBay interface.

3. Registration and User Account

Using SupplyBay requires the creation of a user account. The user is obligated to provide truthful information during registration and to keep it up to date in the event of changes. Login credentials must be kept confidential and protected from access by third parties; the user is liable for activities carried out using their login credentials to the extent they are responsible for the misuse. Any suspected misuse must be reported to us without delay. A user account may only be created by natural persons aged 18 or older.

4. Linking Your eBay Account

Connecting your own eBay account via eBay OAuth is voluntary and requires the user's explicit authorization. The user remains solely responsible for complying with eBay's own terms of use in connection with their eBay account. The connection can be revoked at any time via the account settings in SupplyBay or directly through the eBay account; in this case, the features dependent on it will no longer be available.

5. User Obligations

The user agrees not to use SupplyBay to:

  • violate applicable law or the rights of third parties,
  • circumvent technical protection measures or exploit or specifically search for security vulnerabilities,
  • place excessive load on the Service or the eBay interface through automated or abusive access,
  • use third parties' login credentials or unlawfully share their own login credentials,
  • reverse-engineer, decompile, or reproduce the application's source code without authorization, except where mandatorily permitted by law.

6. Availability and Changes to the Service

We strive to keep SupplyBay available as continuously as possible but do not guarantee uninterrupted availability. Maintenance work, further development, as well as outages or changes at the third-party providers we use (including eBay, Supabase, Vercel, and Resend) may result in temporary limitations. We reserve the right to further develop, modify, or discontinue features of SupplyBay.

7. Pricing

To the extent SupplyBay is currently offered free of charge or as part of a demo, no fees apply during this period. Should paid services be introduced in the future, pricing, scope of services, and payment terms will be communicated to the user separately before any contract is concluded.

8. Term and Termination

The usage agreement runs for an indefinite period. The user may delete their account at any time without giving reasons, or request deletion via kontakt@supplybay.de. We may terminate the usage agreement with reasonable notice, or suspend or terminate the user account where we have a legitimate interest in doing so, in particular in the event of a violation of these Terms of Use. The right to extraordinary termination for good cause remains unaffected.

9. Liability

We are liable without limitation for intent and gross negligence, as well as under the provisions of the German Product Liability Act and for damages resulting from injury to life, body, or health. In the event of slightly negligent breach of material contractual obligations (cardinal obligations), the fulfilment of which is essential to the proper performance of the usage agreement and on whose observance the user may regularly rely, our liability is limited to the foreseeable damage typical for this type of contract. Liability is otherwise excluded.

We accept no liability for the accuracy, completeness, or availability of data obtained via the eBay interface or other third-party providers, nor for damages resulting from a notification of a stock or price change being delayed or not delivered at all.

10. Data Protection

Information on the processing of personal data can be found in our Privacy Policy.

11. Changes to These Terms of Use

We may amend these Terms of Use with effect for the future, to the extent necessary to adapt to changed legal or technical circumstances and provided this does not unreasonably disadvantage the user. Registered users will be informed of changes in good time, e.g. by email. If the user does not object within four weeks of receiving the notice of change, the amended terms shall be deemed accepted; we will separately draw attention to this right of objection and the significance of silence in the notice of change. In the event of an objection, both parties are entitled to terminate the agreement.

12. Final Provisions

These Terms of Use are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the state in which the user, as a consumer, has their habitual residence remain unaffected. Should individual provisions of these Terms of Use be or become invalid, the validity of the remaining provisions shall remain unaffected.
